1 Who We Are

Permian Basin RV Park is an RV park located at 301 W Bell St, Stanton, TX 79782, offering nightly, weekly, monthly, and extended-stay RV sites with full hookups, along with amenities including a swimming pool, laundry facility, restrooms and showers, and guest WiFi. Reservations may be made through our website, through an authorized online booking platform, by telephone at (432) 756-2272, or in person at our office.

2 SMS Terms and Conditions

2.1Program Description and Message Types

Permian Basin RV Park operates a text messaging program sent from (432) 237-4673. By providing your mobile telephone number and giving consent, you agree to receive text messages from us. The messages you may receive include:

• Marketing messages about special offers, discounts, and service updates.
• Non-marketing messages about reservation confirmations, reservation reminders, check-in and check-out instructions, site assignments, billing and payment notices, customer service replies, and park operational or emergency alerts.

Consent for marketing messages is collected separately from consent for non-marketing messages, and you may opt into one, both, or neither. Consent is never a condition of making a reservation or purchasing any service, and consent checkboxes are never pre-selected.

• Carriers are not liable for delayed or undelivered messages.
• Delivery of text messages is subject to effective transmission by your mobile carrier and is not guaranteed.

2.5Age Restriction

You must be at least 18 years of age to consent to receive text messages from us and to make a reservation. By opting in, you confirm that you are 18 years of age or older and that you are the account holder of, or are authorized to use, the mobile telephone number you provided. You agree to notify us if you relinquish or change that number.

3 Reservations

All reservations are subject to availability and confirmation. You must be at least 18 years of age to make a reservation.

You must provide accurate and complete information, including the name of the registered guest, contact information, RV type and length, number of occupants, pets, and vehicle information.

Site assignments are made at our discretion and may change for operational reasons. We will make reasonable efforts to honor site preferences but cannot guarantee a specific site.

Rates are those shown at the time of booking and are subject to applicable taxes and fees. Rates for stays not yet reserved are subject to change.

4 Payment, Deposits, and Cancellations

• A deposit or advance payment may be required to confirm a reservation. The balance is due as disclosed at the time of booking or upon arrival.
• Cancellation and refund terms are those disclosed to you at the time of booking and stated in your reservation confirmation. Cancellations must be received by the deadline stated in that confirmation to qualify for a refund. Early departures, no-shows, and late cancellations may not be refundable.
• Extended-stay and monthly guests may be subject to a separate written agreement, deposits, metered utility charges, and notice requirements, which control to the extent they conflict with these Terms.
• Past-due balances may result in additional fees, suspension of services, or removal from the park as permitted by law.

5 Check-In, Check-Out, and Occupancy

• Check-in and check-out times are those posted at the office and stated in your reservation confirmation. Late departure may incur an additional night’s charge.
• Only the guests, vehicles, and pets listed on the registration may occupy the site. Unregistered occupants or vehicles may be asked to leave or may be charged additional fees.
• Visitors must register at the office and comply with all park rules while on the property.

6 Park Rules and Conduct

All guests, occupants, and visitors must comply with the park rules posted at the office and provided at registration, which are incorporated into these Terms. The rules address quiet hours, speed limits, pets and leash requirements, site cleanliness and maintenance, trash disposal, utility connections, use of the pool, laundry, and other amenities, campfires and grills, firearms and fireworks, and the condition and roadworthiness of RVs.

We reserve the right to refuse service, terminate a stay, and require any guest, occupant, visitor, or vehicle to leave the property for violation of these Terms or the park rules, for conduct that endangers or disturbs others, for illegal activity, or for nonpayment. Removal for cause may occur without refund to the extent permitted by law.

7 Guest WiFi and Amenities

Guest WiFi and amenities such as the pool, laundry, and common areas are provided as a convenience and may be unavailable, interrupted, or discontinued without notice. No refund or rate adjustment is provided for temporary unavailability.

You may not use the park network for unlawful activity, to infringe intellectual property rights, to transmit malicious code, or in any manner that degrades service for other guests. We may suspend network access for violations.

Amenities are used at your own risk. Children must be supervised by an adult in all amenity areas. There is no lifeguard on duty at the pool.

8 Assumption of Risk and Personal Property

Camping, use of park amenities, and presence on the property involve inherent risks. You voluntarily assume those risks for yourself, your occupants, your minors, and your pets. You are responsible for the security of your RV, vehicles, and personal property. We are not responsible for loss, theft, or damage to any RV, vehicle, or personal property, or for damage caused by weather, utility interruption, power surge, wildlife, or the acts of other guests or third parties.

9 Guest Responsibility and Indemnification

You are responsible for any damage to park property caused by you, your occupants, your visitors, or your pets, and agree to reimburse Permian Basin RV Park for the cost of repair or replacement. You agree to indemnify, defend, and hold harmless Permian Basin RV Park, its owners, managers, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising from your stay, your use of the website or amenities, your violation of these Terms or the park rules, or your violation of applicable law.

10 Website Use and Intellectual Property

The website and its content, including text, images, logos, and design, are owned by us or our licensors and are protected by applicable intellectual property laws. You may use the website for personal, non-commercial purposes related to booking and managing a stay. You may not copy, reproduce, scrape, reverse engineer, or create derivative works from the website without our prior written permission, or use the website in any manner that interferes with its operation or security.

11 Disclaimers

The website, the park, and all amenities are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted or error-free or that content is accurate or complete.

12 Limitation of Liability

To the maximum extent permitted by law, Permian Basin RV Park and its owners, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to your stay, the website, our amenities, or our messaging program. Our total aggregate liability for any claim will not exceed the amount you paid to us for the reservation giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

13 Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including severe weather, flood, fire, utility or internet outage, labor disruption, government order, public health emergency, or acts of God. In such events we may close the park or portions of it and will apply our cancellation and refund terms as circumstances permit.

14 Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms, your stay, or the website will be brought exclusively in the state or federal courts located in Martin County, Texas, and you consent to the jurisdiction of those courts.

15 Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or severed and the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, the park rules, and any signed extended-stay agreement, constitute the entire agreement between you and us regarding their subject matter.

16 Changes to These Terms

We may revise these Terms at any time. The “Last Updated” date above reflects the most recent revision. Continued use of the website or the park after changes are posted constitutes acceptance of the revised Terms.
